1. General Terms
By placing an order with Miela Beau Studio (“Company,” “we,” “us”), you (“Customer,” “you”) agree to be bound by these Terms and Conditions. These terms apply to all custom clothing orders, alterations, and related services.
2. Order Process and Acceptance
2.1 Order Placement
- All orders must be placed through our authorised channels (website, email, bank transfer or in-person consultation)
- Orders are not binding until confirmed by us in writing and deposit is paid
- We reserve the right to refuse any order at our discretion
2.2 Design Consultation
- Initial design consultations are included in the deposit price.
- Additional design revisions for the same order beyond 2 rounds may incur extra charges.
- Sketches may be provided at our discretion in order to clarify the final design.
- Final design approval must be provided in writing before production begins.
- Production start date will be communicated thereafter.
2.3 Measurements
- Accurate measurements are the customer’s responsibility unless taken during a consultation.
- We offer professional measuring services for free.
- Customers using self-measurements assume responsibility for accuracy.
3. Materials & Sourcing
- Orders with less than two weeks timeline requires the customer to provide all materials and accessories.
- Fabric sourcing service is optional and available for all other orders.
- If fabrics and accessories are to be provided, the customer is required to present these during initial design consultations.
- Fabric sourcing service can be provided at discretion for an additional non-refundable fee starting from £50
3.1 Pricing
- All prices are quoted in GBP
- Prices are subject to change based on material selection and design complexity
- Additional charges may apply for rush orders (2 weeks or less notice) or special requests
3.2 Payment Terms
- Deposit: 50% non-refundable deposit required to begin production after design approval
- Balance: Balance must be paid in full at the time of pickup / delivery.
4. Production Timeline
4.1 Standard Timeline
- Production begins after final design approval and deposit payment.
- Standard delivery time: 2 weeks from confirmation of final design.
- Rush orders, 2 weeks or less, are available for additional fee 20-30% surcharge.
4.2 Delays
- Timelines are estimates and may vary due to material availability or complexity.
- We will notify customers of any significant delays.
- Delays do not constitute grounds for order cancellation or refund.
5. Materials and Quality
5.1 Quality Standards
- All garments are subject to our quality control process.
- Minor variations in colour, texture, or finish are normal in custom work.
- We stand behind the craftsmanship of our products.
6. Sizing and Fit
6.1 Custom Sizing
- All garments are made to individual measurements provided
- First Fitting: Included in deposit price for major alterations
- Final Fitting: Also included in the deposit price for alterations
6.2 Fit Guarantee
- We guarantee proper fit when professional measurements are used
- Fit adjustments included within 1-3 days of delivery
- Customer measurement errors are not covered under fit guarantee
7. Changes and Modifications
7.1 Design Changes
- Changes to approved designs may incur additional charges at the Company’s discretion.
- Major changes may affect delivery timeline.
- No changes permitted once production has begun.
7.2 Order Cancellation
- Orders may be canceled before production start date begins.
- Deposit only refundable prior to communicated production date.
- Deposits are non-refundable after communicated production date.
8. Delivery and Pickup
8.1 Delivery Options
- Pickup: Available at our location during business hours unless agreed prior otherwise.
- Shipping: Available at customer expense.
- Local Delivery: Available in Croydon for additional fee.
8.2 Delivery Responsibility
- Risk of loss transfers to customer upon delivery/pickup.
- Customers must inspect items upon receipt.
- Shipping delays beyond our control are not our responsibility.
9. Returns and Exchanges
9.1 Custom Nature
- No Returns: Due to the custom nature of our products, all sales are final
- No Exchanges: Items cannot be exchanged for different sizes or styles
- Final fitting: minor alterations permitted at no additional cost
9.2 Defect Policy
- Manufacturing defects will be repaired or remade at no charge.
- Defects must be reported within 7 days of delivery.
- Normal wear and tear is not considered a defect.
10. Intellectual Property
10.1 Design Ownership
- Custom designs created by us remain our intellectual property
- Customers receive unlimited personal use rights for commissioned designs
- Commercial use of designs requires separate licensing agreement
10.2 Customer Designs
- Customers warrant they own rights to any designs they provide
- Customer indemnifies us against any intellectual property claims
11. Privacy and Data Protection
11.1 Personal Information
- We collect and store customer measurements and preferences
- Information used solely for order fulfillment and customer service
- We do not sell or share personal information with third parties
11.2 Photos and Marketing
- We may request permission to photograph completed garments
- Customer consent required before using photos for marketing purposes
12. Limitation of Liability
12.1 Damages
- Our liability is limited to the price paid for the specific item
- We are not liable for indirect, consequential, or special damages
- This includes loss of use, loss of profits, or other business losses
12.2 Force Majeure
- We are not liable for delays or failures due to circumstances beyond our control
- This includes natural disasters, supplier failures, or government regulations
13. Dispute Resolution
13.1 Governing Law
- These terms are governed by the laws of the United Kingdom
13.2 Mediation
- Customers agree to attempt mediation before pursuing legal action
- Mediation will be conducted by a mutually agreed mediator
